Account Setup

We will setup your account after we receive payment and we and/or our payment partner(s) will cancel the order(s) incase of fraud. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under. If there is ever an abuse issue or we need to contact you, the primary email address on file will be used for this purpose. It is your responsibility to ensure the email address on file is current or up to date at all times. Providing false contact information of any kind may result in the termination of your account. In dedicated server purchases or high risk transactions, it will be necessary to provide government issued identification for the purchase. If you fail to meet these requirements, the order may be considered fraudulent in nature and be denied.

All services provided by The-D Web Work may only be used for lawful purposes. The laws of the Government of India and the United States of America apply.
The customer agrees to indemnify and hold harmless The-D Web Work from any claims resulting from the use of our services.
Use of our services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. If you believe that your copyright or trademark is being infringed upon, please email hello@thedwork.co.in with the information required. A list of required information may be found here. If the request is of a licensing issue, we may require further documentation.

Cancellations and Refunds

The-D Web Work reserves the right to cancel the account at any time with or without notice.
Any abuse to our staff in any medium or format will result in the suspension or termination of your services.
Customers may cancel at any time via email at hello@thedwork.co.in. There are no refunds on shared, reseller, dedicated servers and VPS,Cloud Servers, administrative fees, install fees for custom software, or domain name purchases.
The-D Web Work must be notified by client at least 3 days(72 hours) before billing cycle for cancellation of service. If you failed to do that you have to pay full renewal charges. Any violation of policies which results in extra costs will be asked customer to pay.
Violations of the Terms of Service will waive the refund policy.
The-D Web Work reserves the right to reject any type of refund request with or without reason.

Refund Policy

On any service or servers, no full refund will be honored. We reserve the right to refund a prorated amount in special cases or no refund at all.

Price Change

The amount you pay for hosting will never increase from the date of purchase. We reserve the right to change prices that has been quoted and the right to increase the amount of resources given to plans at any time.

Hosting Price Or Configuration Exception

In case of high bandwidth or hosting space usage sites, our all type of hosting rates & configurations are not valid. We can increase price or change hosting configurations for those sites without notice. Community site, classifieds site, forum site, picture gallery site, flash site etc are high capacity site. Also if any normal sites usage limit more than 30% we can treat that site also a high capacity site. All decisions depend on The-D Web Work.

Web Development Quotation

Quotations are valid for 7 days and are non-binding. Pricing is subject to change upon the full scope of the project.

Project Scope

Prior to the commencement of work, all projects will be fully scoped and a list of duties created. A contract, or Web Work Agreement, will be drawn accordingly. Should the scope exceed the initial quotation, Simple Site Services will submit a quotation for approval before proceeding. Any kind of content used for website, app, web application or any other shall be provided by the client. The-D Web Work/Dipanjan will not verify the content provided by the client.

Development Fees

Initial minimum 50% advance deposit is required before work on the web project begins. The balance is to be paid on completion and acceptance by the client and prior to making the website accessible to the public. The-D Web Work/Dipanjan unable to provide developed userid, password etc before full payment.

Development Additional Fees

If the quantity of materials delivered by the client exceed the number of agreed upon pages, or if programming differs from the duties specified in the Web Work Agreement, additional fees may apply. Moreover, the client will reimburse Simple Site Services for expenses of production not included in the Web Work Agreement. These expenses could include copy writing, digital photography, and stock photography. These fees will be invoiced after the completion of the web project.

Web Development Damages

Your use of and browsing in this Site are at your risk. Neither The-D Web Work/Dipanjan, nor any other party involved in creating, producing, or delivering this Site and or its content is liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of this Site. Without limiting the foregoing, everything on this Site is provided to you "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. Please note that some jurisdictions may not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. The-D Web Work/Dipanjan also assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect your computer equipment or other property on account of your access to, use of, or browsing in this Site or your downloading of any materials, data, text, images, video, or audio from this Site.

Lawful Purpose

The-D Web Work/Dipanjan reserves the right to refuse service to anyone. Customers may only use our server for lawful purpose. Transmission of any material in violation of any Federal, State or Local regulation is prohibited. This includes, but is not limited to copyrighted material, material legally judged to be threatening or obscene, and material protected by trade secrets. The-D Web Work/Dipanjan expressly forbids anyone from using our servers for the propagation, distribution, housing, processing, storing, or otherwise handling in any way lewd, obscene, or pornographic material, or any other material which we deem to be objectionable, including, but not limited to, pornography, satanic materials, and any and all materials of an adult nature. The designation of any materials as such described above is left entirely to the discretion of The-D Web Work/Dipanjan management.

Indemnification

Customer agrees that it shall defend, indemnify, save and hold The-D Web Work/Dipanjan harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against The-D Web Work/Dipanjan, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless The-D Web Work/Dipanjan against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with The-D Web Work/Dipanjan; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from The-D Web Work/Dipanjan's server.

Denial of Service

We reserve the right to refuse service to anyone at any time for any reason.

Acknowledgement

The-D Web Work/Dipanjan does not verify any client's nature of business or the data client provides. You agree that you as the person legally responsible for use of this account are at least 18 years of age. You agree to supply The-D Web Work/Dipanjan with a current and truthful name, postal address and telephone number for our records, and you have a continued obligation to keep this information current. You also agree that you are an authorized user of any credit/debit card that you supply to us and agree that we have an obligation to fully investigate any possible fraudulent credit/debit card use. By placing, hiring and continuing to maintain or place information at The-D Web Work servers you are stating and acknowledging that you have read the aforementioned terms and conditions and that you understand such terms and conditions and agree to be bound by them.

Disclaimer

The-D Web Work/Dipanjan shall not be responsible for any damages your business may suffer. The-D Web Work/Dipanjan makes no warranties of any kind, expressed or implied for services we provide. The-D Web Work/Dipanjan disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by The-D Web Work/Dipanjan.

Disclosure to law enforcement

The-D Web Work/Dipanjan may disclose any subscriber information to law enforcement agencies without further consent or notification to the subscriber upon lawful request from such agencies. We will cooperate fully with law enforcement agencies.

Changes to the TOS

The-D Web Work/Dipanjan reserves the right to revise its policies at any time without notice. All clients of The-D Web Work/Dipanjan must adhere to the above policies. Failure to follow any term or condition will be grounds for immediate account deactivation and/or fines billed to the Customer.
